NOVEL - "INCENTIVE"

COMPLEX LITIGATION

1. Years ago, Dirk von Guenthner had a conversation with one of the attorneys who had used his services on several occasions. This is the gist of the conversation:

a. Dirk: “John, you know, all the cases I get hired to provide my services are really complicated”.

b. John: “If the cases weren’t complicated, the attorney would do the case himself.”

2. In Hawaii, if you ask various experts that provide various services to counsel: “Who is the most qualified and proficient person to engage in a large document case?” The answer likely will be Dirk von Guenthner.

3. Those who know Dirk will say that he is a very organized person in every way.

a. With the highest level of self discipline and dedication to the most cost effective outcome to very large cases (which can include hundreds of bankers boxes of records), Dirk organizes the records so that counsel and other experts can use them without guidance.

b. The case is divided into logical groupings and often are set up so chronological and/or alphabetical sequences can be followed.

c. With artfully created indexes, a document can be retrieved almost instantaneously.

4. Some cases can contain less than a single archive box of documents and still be extremely complex. In those circumstances, Dirk will identify and segregate the issues of the case in a manner that can explain the otherwise complex issues.
